Final Sale, Cancellation, Transfer, and Liability Policy

1. Final Sale and No Refunds
All bookings and payments made to XaLani Travels are final, non-refundable, and non-transferable except as expressly stated herein. By submitting payment, the guest acknowledges and agrees that under no circumstances—including, but not limited to, personal conflicts, medical emergencies, illness, family emergencies, travel delays, weather, acts of God, government actions, or any other reason—shall refunds, credits, or chargebacks be issued.

The guest further agrees not to dispute charges with their financial institution. Any attempted chargeback or payment dispute shall constitute a breach of this agreement, and XaLani Travels reserves the right to pursue all legal remedies, including recovery of fees, costs, and expenses associated with such action.

2. Reservation Transfer and Waitlist Policy
If the guest is unable to attend, they forfeit all rights to the booking. However, if a waitlist exists, XaLani Travels may, at its sole discretion, allow the reservation to be transferred to another approved guest.

• XaLani Travels is not responsible for locating a replacement guest.

• XaLani Travels is not responsible for collecting, facilitating, or guaranteeing payment between the original guest and the replacement guest.

• Any financial transaction between the original guest and replacement guest is solely between those parties.

• XaLani Travels reserves the exclusive right to approve or deny any transfer request for any reason.

3. Assumption of Risk and Limitation of Liability
By participating in travel arrangements, the guest voluntarily assumes all risks associated with travel, including but not limited to injury, illness, delays, cancellations, loss of property, inconvenience, or other unforeseen circumstances.

XaLani Travels, its owners, agents, affiliates, and representatives shall not be held liable for:

• Any injury, loss, accident, delay, inconvenience, or damage to persons or property

• Acts or omissions of third-party providers, including hotels, airlines, transportation providers, or vendors

• Changes, interruptions, or cancellations beyond its control

To the fullest extent permitted by law, XaLani Travels’ liability shall be limited to the amount paid directly to XaLani Travels for the booking.

4. Force Majeure
XaLani Travels shall not be liable or responsible for failure to perform its obligations when such failure is due to events beyond its reasonable control, including but not limited to:

• Acts of God

• Natural disasters

• Pandemics or public health emergencies

• War, terrorism, or civil unrest

• Government orders or travel restrictions

• Labor strikes

• Weather conditions

• Supplier or vendor cancellations

In such cases, no refunds shall be issued.

5. Agreement and Acknowledgment
By submitting payment, the guest acknowledges that they have read, understood, and agreed to all terms and conditions outlined in this policy and voluntarily waive certain legal rights, including the right to refunds and liability claims as described herein.
